Specified Products
Pierce Transit has included all approved manufacturer(s) name and numbers for all required products contained in this bid. Following the approved manufacturer(s) product information, for each item is one of two designations: (1) "or pre-approved equal"; (2) "no substitutions accepted". Additional manufacturer(s) products may be added for designation (1) by following the Pre-Approval process.

Pre-Approval Process
Prior to bid submittal, Pierce Transit requires prospective bidders to submit a product sample of all items to be offered as an "or equal". Sample product submittals shall include information regarding submitting company, manufacturer’s name and item or reorder number, manufacturer’s specification, manufacturer pack size, list of variations from our specification, and any other information that will assist Pierce Transit in making an "or equal" determination. Bidders are not limited to the number of "or equal" items they may submit.

Pierce Transit shall review all samples for compliance with specifications and shall approve or disapprove any variations. Pierce Transit reserves the sole right to make the "or equal" determination. Pierce Transit's decision shall be final. All prospective bidders shall be notified by written addendum to the specifications of all pre-approved products.

Term of Contract
The contract shall be for a period of one (1) year.

Pricing
Prices quoted shall be firm for the term of the contract.

Product Substitutions After Award
The Contractor must obtain Pierce Transit's approval prior to making a substitution for any product for any reason including the inability to meet delivery requirement with the contracted product. The substituted product will be priced the same or less than the product that should have been delivered.

If a designated product is no longer available from the manufacturer as previously approved by Pierce Transit, a permanent substitution will be necessary. The Contractor shall give thirty (30) calendar days advance written notice to Pierce Transit about pending unavailability. The Contractor shall include a recommended substitution description, price and any other pertinent information along with a sample. Pierce Transit reserves the right to accept or reject the Contractor’s recommendation.
